Opening · a constitutional or legal provision

Article 246 of our constitution provides for distribution of subjects between the Union List, State List and Concurrent List. The Seventh schedule provides for it (the distribution of subjects).

Body · points and prose

Revisiting seventh schedule : Time Ripe

(1) For better rationalisation of subjects ↓ removing redundant subjects

(2) Increasing centralisation of 7th schedule demands for revisit (Eg) No. of subjects in state list decreased, concurrent increased

(3) Demand from states → for greater autonomy over subjects (Eg) Education earlier in state list now in concurrent list states oppose such (42nd AA) acts

(4) Including of emergent subject in the list (Eg) Cybercrime

(5) Increase democratic control of residuary subjects (Article 248) ↓ Sarkaria, Santhanam Committee Recommendation: Residuary subjects should be transferred in concurrent list

(6) Increase cooperative federalism

Diagram
- Issues - Reluctance by Centre - some union concurrent subjects can't be shifted to state → need for both centre-state involvement - (Eg) Forest

Way forward (1) Accepting recommendation of the Sarkaria Commission and Punchi Commission

(2) Greater deliberation through Inter-State Council with proper cooperation, the 7th Schedule can be gradually optimised
