Opening · a constitutional or legal provision

NCSC is a constitutional body under article 338 of the constitution under 89th Constitution Amendment for the welfare of SCs.

NCSC has been effective as:

Body · points

(1) Looked after individual complaints (eg. Dalit Rape at Unnao) through CIVIL court like powers (2) Gave rulings on collective issues of manual scavenging (3) To help in research in policy building & suggest policy to government (4) To collaborate with civil society groupings on issues (eg) with Dalit Panthers etc (5) Oversees the functioning of the N-SC-Finance Development corporation (6) check efficacy of policies (eg) Reservation, Stand Up India scheme (7) can seek summons, witness and evidence on cases

But there are concerns:

(1) Lack of autonomy as central appointment and funds are by the M/o Social Justice (2) Lack of adequate staff (3) Dalit activists like Lalita Pawar say that disconnect with grassroots (4) Non binding regulations, only advisory (5) Discrimination continues and even intersectionality like situation of dalit women is not taken into account (6) only engaged in routine tasks & lack of breakthrough cases

Close · a way forward

Thus NCSC has to be attached closer to grassroots to cater to overall development on lines of article 46 of constitution.
