Question 94: Polity and Governance

With reference to the Indian Parliament, consider the following statements :

  1. 1.A bill pending in the Lok Sabha lapses on its dissolution.
  2. 2.A bill passed by the Lok Sabha and pending in the Rajya Sabha lapses on the dissolution of the Lok Sabha.
  3. 3.A bill in regard to which the President of India notified his/her intention to summon the Houses to a joint sitting lapses on the dissolution of the Lok Sabha.

Which of the statements given above is/are correct ?

a1 only
b1 and 2
c2 and 3
d3 only

AnswerUPSC’s answer is (b).

A bill pending in the Lok Sabha lapses when that House is dissolved, and so does a bill passed by the Lok Sabha but pending in the Rajya Sabha. A bill for which the President has notified a joint sitting does not lapse on dissolution (Article 108(5)). So statements 1 and 2 are correct and statement 3 is wrong. Remember: a bill pending only in the Rajya Sabha does not lapse.

  • 1. A bill pending in the Lok Sabha lapses on its dissolution.
  • 2. A bill passed by the Lok Sabha and pending in the Rajya Sabha lapses on dissolution.
  • 3. A bill for which a joint sitting is notified does not lapse on dissolution.

How you could have got this

  1. If you were sure statement 1 is correct, (c) and (d) go: each of them leaves 1 out.

What you needed to know: A bill pending in the Lok Sabha lapses on its dissolution.

  2. Then, if you were sure statement 2 is correct, (a) goes: it leaves 2 out.

What you needed to know: A bill passed by the Lok Sabha and pending in the Rajya Sabha lapses on dissolution.

Only (b) is left. You didn’t need statement 3.

Which options go is worked out from UPSC’s key and the options, not by a model.

Why each option is right or wrong
  • (a) Wrong: it leaves out statement 2, which is correct.
  • (b) Right: statements 1 and 2 are correct.
  • (c) Wrong: statement 3 is false and statement 1 is true.
  • (d) Wrong: a bill under a joint sitting notice does not lapse.
