Question 95: Polity and Governance

With reference to the Parliament of India, consider the following statements :

  1. 1.Prorogation of a House by the President of India does not require the advice of the Council of Ministers.
  2. 2.Prorogation of a House is generally done after the House is adjourned sine die but there is no bar to the President of India proroguing the House which is in session.
  3. 3.Dissolution of the Lok Sabha is done by the President of India who, save in exceptional circumstances, does so on the advice of the Council of Ministers.

Which of the statements given above is/are correct ?

a1 only
b1 and 2
c2 and 3
d3 only

AnswerUPSC’s answer is (c).

Statement 1 is wrong: the President prorogues a House on the advice of the Council of Ministers, like other acts of the President. Statements 2 and 3 are right: prorogation usually follows adjournment sine die, though the President may prorogue a House that is in session, and the Lok Sabha is dissolved by the President, normally on the Council of Ministers' advice. Remember: both prorogation and dissolution are done on ministerial advice.

  • 1. The President prorogues a House on the advice of the Council of Ministers.
  • 2. Prorogation usually follows adjournment sine die, and a House in session can also be prorogued.
  • 3. The President dissolves the Lok Sabha, normally on the Council of Ministers' advice.

How you could have got this

  1. If you were sure statement 1 is not correct, (a) and (b) go: each of them includes 1.

What you needed to know: The President prorogues a House on the advice of the Council of Ministers.

  2. Then, if you were sure statement 2 is correct, (d) goes: it leaves 2 out.

What you needed to know: Prorogation usually follows adjournment sine die, and a House in session can also be prorogued.

Only (c) is left. You didn’t need statement 3.

Which options go is worked out from UPSC’s key and the options, not by a model.

Why each option is right or wrong
  • (a) Wrong: prorogation does need the Council of Ministers' advice.
  • (b) Wrong: statement 1 is false.
  • (c) Right: statements 2 and 3 are correct.
  • (d) Wrong: statement 2 is also correct.
