Question 93: Polity and Governance

With reference to the Speaker of the Lok Sabha, consider the following statements : While any resolution for the removal of the Speaker of the Lok Sabha is under consideration

  1. 1.He/She shall not preside.
  2. 2.He/She shall not have the right to speak.
  3. 3.He/She shall not be entitled to vote on the resolution in the first instance.

Which of the statements given above is/are correct ?

a1 only
b1 and 2 only
c2 and 3 only
d1, 2 and 3

AnswerUPSC’s answer is (a).

Under Article 96, while a resolution for removing the Speaker is under consideration, the Speaker shall not preside, but has the right to speak and take part in the proceedings. The Speaker can also vote in the first instance on the resolution, though not in the case of a tie. So only statement 1 is correct; statements 2 and 3 are wrong.

  • 1. The Speaker does not preside while his or her removal is under consideration.
  • 2. The Speaker has the right to speak and take part in proceedings.
  • 3. The Speaker may vote in the first instance, but not in a tie.

How you could have got this

  1. If you were sure statement 2 is not correct, (b), (c) and (d) go: each of them includes 2.

What you needed to know: The Speaker has the right to speak and take part in proceedings.

Only (a) is left. You didn’t need statements 1 or 3.

Which options go is worked out from UPSC’s key and the options, not by a model.

Why each option is right or wrong
  • (a) Right: only the bar on presiding applies.
  • (b) Wrong: the Speaker has the right to speak.
  • (c) Wrong: the Speaker may speak and vote in the first instance.
  • (d) Wrong: statements 2 and 3 are incorrect.

Answer: UPSC’s key. Explanation: written by UPSC Grade, not by UPSC.
