Question 54: Polity and Governance

With reference to the Delimitation Commission, consider the following statements :

  1. 1.The orders of the Delimitation Commission cannot be challenged in a Court of Law.
  2. 2.When the orders of the Delimitation Commission are laid before the Lok Sabha or State Legislative Assembly, they cannot effect any modifications in the orders.

Which of the statements given above is/are correct?

a1 only
b2 only
cBoth 1 and 2
dNeither 1 nor 2

AnswerUPSC’s answer is (c).

The Delimitation Commission's orders have the force of law and cannot be questioned in any court (Article 329(a) bars courts in this matter, and the Delimitation Act says so explicitly). The orders are laid before the Lok Sabha or the State Legislative Assembly, but those bodies cannot make any modification in them.

  • 1. The orders have the force of law and cannot be challenged in a court.
  • 2. When laid before the House or Assembly, they cannot be modified.

How you could have got this

  1. If you were sure statement 1 is correct, (b) and (d) go: each of them leaves 1 out.

What you needed to know: The orders have the force of law and cannot be challenged in a court.

  2. Then, if you were sure statement 2 is correct, (a) goes: it leaves 2 out.

What you needed to know: When laid before the House or Assembly, they cannot be modified.

Only (c) is left. This one needs every statement.

Which options go is worked out from UPSC’s key and the options, not by a model.

Why each option is right or wrong
  • (a) Incomplete: the Lok Sabha or Assembly also cannot modify the orders.
  • (b) Incomplete: the orders also cannot be challenged in a court.
  • (c) Correct: the orders are final in court and cannot be modified by legislatures.
  • (d) Wrong: both statements are correct.

Answer: UPSC’s key. Explanation: written by UPSC Grade, not by UPSC.
