Why in news
On 19 July 2026 the CCPA said it has begun suo motu action against 41 restaurants for adding service charge to bills by default. It has already passed final orders against seven establishments, including a ₹50,000 penalty on Chaayos.
What it is
The Central Consumer Protection Authority is the regulator set up under the Consumer Protection Act, 2019. It protects consumer rights as a class and acts against unfair trade practices and misleading advertisements. It can order recalls and refunds, and impose penalties, with an Investigation Wing headed by a Director General.
Legal basis of the action
CCPA acted under the Consumer Protection Act, 2019 and the E-Commerce Rules, 2020, read with the Explosives Act, 1884 and the Ammonium Nitrate Rules, 2012.
Licence requirement
Lawful sale needs a licence. Platforms must show sellers' valid PESO licence details and verify buyers' identity and licensed status.
Scale of delisting
Platforms furnished details of 3,940 sellers and listing entries, all of which were delisted.
Offences held
The listings were held to be misleading advertisements and unfair trade practices under Sections 2(28) and 2(47).
Hearing before final order
The Act requires a hearing opportunity before a final order is passed.
Legal basis
The order was passed under Sections 10, 20 and 21 of the Consumer Protection Act, 2019.
E-Commerce Rules
The Consumer Protection (E-Commerce) Rules, 2020 apply to marketplace e-commerce entities whatever business model they claim.
Wider examination
Seven more platforms are under examination, including India MART, Justdial and TradeIndia, for sale of explosives and precursors.
Guidelines date
The service charge guidelines were issued on 4 July 2022. They bar automatic or default service charge and say any payment must be voluntary.
Court backing
The Delhi High Court upheld the guidelines on 28 March 2025 in National Restaurant Association of India v. Union of India. It said mandatory service charge is contrary to law.
Penalty in the Chaayos case
CCPA fined Chaayos ₹50,000 and ordered it to refund the service charge. It also ordered a change to the billing software across all outlets.
Complaint channel
Complaints come through the National Consumer Helpline, toll-free number 1915.

Don’t confuse with CCPA vs NCDRC: CCPA is the regulator that investigates and penalises; the NCDRC is a quasi-judicial body that hears appeals against CCPA orders under Section 24.

Don’t confuse with PESO vs CCPA: PESO licenses explosives under the Explosives Act; CCPA enforces consumer law against platforms that ignore this.

Don’t confuse with CCPA vs consumer commissions: CCPA is a regulator that acts on class-wide consumer rights and unfair trade practices. District, State and National Commissions are quasi-judicial bodies that decide individual consumer disputes.

Laws, judgments and statutory bodies: 30 Prelims questions since 2013 (what the law says, who chairs, legal basis). In Mains, 44 news-triggered questions, most in GS2, asking for provisions and challenges.

No practice question for this one; the card may still help an answer. Why: Statutory body under the Consumer Protection Act, 2019, with a service charge ruling. Statutory bodies drew only 7 Prelims questions since 2013, and this action brings few new testable facts.

Worth revising until Prelims 2028: most news questions come within two years of the event.
