XYZ is a premiere coaching institute located in Chatterjee Nagar locality of Himnagar. XYZ specialises in the coaching for medical and engineering entrance examination. The main office of the coaching, where the daily classes are conducted, is located in a congested locality, from where several other coaching institutes also operate. One day, while classes were in session in the top floor of the building and some 200 odd students were in attendance, a fire broke out in the premises of XYZ coaching. The fire incident created a commotion among those present in the building. Everyone, in a state of confusion, started running helter-skelter. Some students rushed to the very narrow stairs. Many stumbled and fell, hurting themselves. The emergency exit plan of the building was not suitable to cater to the large number of students and staff. In order to save themselves from asphyxiation, some students broke the window of the classroom. However, in absence of a fire stairs they had to climb down using the balcony ledge. In the process, many students had a free fall and hurt themselves badly. While two boys lost their life due to stampede caused while exiting the building, one girl got fatally injured while climbing down the ledge. The civil administration immediately started an audit of the building. Joseph is posted as the Municipal Commissioner of Himnagar. Chatarjee Nagar falls under his jurisdiction. Joseph has ordered an enquiry into the whole incident. Coincidentally, Joseph's younger brother, Frank, is also a student of XYZ coaching. He was not present in the coaching during the fateful day. The owner of the XYZ coaching approaches Joseph and requests him to be lenient in the enquiry report. They propose that looking at the good track record of Frank they are willing to give a scholarship to fund not only his coaching fees but also his graduation from any college in the country. They also promise that since Frank is a sincere student, they will dedicate their top faculty to ensure that Frank comes out with flying colours in the coming under graduate entrance examination. Joseph knows that his brother has repeatedly failed in the entrance examinations earlier and a special focus will help him immensely. Also, Joseph himself was under student debt, which he was still paying in small instalments from his own salary. Recently married, and having risen from a poor family, Joseph has always worried about funding his brother's education. a) Identify various ethical concerns in the case study. b) You are a friend of Joseph. Joseph turns to you for advice. What advice will you give to joseph and why?

Prakash and Meena were a married couple living in Gurgaon, Haryana. Both Prakash and Meena were corporate executives, working in XYZ retail and ABC enterprises respectively. The two were leading a rewarding professional life. However, as both worked in different companies and often had different office timings, their personal lives were getting affected. Due to their busy schedules and official commitments, they were unable to find sufficient time for each other. Things came to such a pass that the two could not spend their last anniversary together. While Prakash was working on an important project, Meena was busy with the launch of a new product. Though the two understood the importance of professional commitments, the lack of quality time with each-other was increasingly becoming a cause for concern and frustration. One day Prakash informed Meena about a vacancy in his company for the post of regional manager. Prakash, who himself was working at the same position, knew that this post was an ideal opportunity for Meena professionally. While Meena's work in her company was well appreciated and her prospects for growth were sound, she was still willing to grab the present opportunity. This would have enabled the two of them to work in a common office space, with relatively more coherence in their office timings. Consequently, she applied for the vacancy in Prakash's company. As Meena was reasonably qualified for the job and had good experience, she was hired by Prakash's company. The two were very happy about the prospects of working together. Besides working from a common office space, Prakash and Meena were able to go to and return from work together. The two were, resultantly, very happy about this positive change in their lives. Meena quickly adjusted to the new office environment and began her work in the same department as that of Prakash. Meena's positive work came into the notice of her superiors. She was frequently appreciated for her diligence and sincerity. XYZ retail was in the process of preparing a presentation for a potential government contract. While Prakash was expecting that he would be chosen for preparation, the branch head of XYZ retail entrusted Meena with this strategically important task. Prakash was visibly disappointed with this, as he had been preparing for this task for a long time. Meena could also sense Prakash's dejection, as he not only didn't congratulate Meena but also pointed out how it should have been him doing the job. Meena, as was her nature, worked hard on the report, and successfully made the presentation to the client. As the report was made and presented in an efficient manner, XYZ retail gained a big contract from the government. While the entire office was congratulating Meena for her success, Prakash remained indifferent towards Meena's achievement. Meena was visibly hurt by Prakash's behaviour. Meena's success with the government contract earned her a promotion, and she was made the head of her department. This further enraged Prakash, as now he was supposed to report to Meena. Moreover, Prakash's behaviour at the workplace changed significantly. He started misbehaving with his juniors over small things. He became careless in his work, often leading to mistakes and errors. Prakash's behaviour at the workplace had a spill-over effect on Prakash and Meena's personal lives. One day he slapped an office peon for entering his cabin without knocking. After an enquiry about the incident, Meena recommended suspension of Prakash. While the two had continuously quarrelled over trivial things since her promotion, this time Prakash's career was at stake leading to a huge fight. Earlier Prakash and Meena tried to spend time together whenever possible, now the two despised being together at home and office. While Meena could not comprehend Prakash's behaviour, Prakash was jealous of Meena's success. Meena began to re-evaluate her decision to join XYZ retail.

Corporate GovernanceEthical Dilemmas in Government
Mr. Gopal Mahto is the sitting Chief Minister of one of the most populous states in India. He is a young and dynamic leader, popular not just in his state but across the country. Many political analysts opine that he has the potential to become Prime Minister of India in future. One day, the CM was taking a review meeting of law-and-order situation in the state, with senior officials in the state capital. Suddenly he felt a light pain in his abdomen. The CM had been feeling such bouts of pain since a long time, but like always he neglected it this time too, and continued with the meeting. However, in the next few weeks, the intensity of pain increased and the CM was forced to see a doctor. After initial examination, the doctor gave some medicines and prescribed few tests. After few days, the report came and it showed that the CM is suffering from ‘Liver Cirrhosis.’ It was in the advanced stage and posed a threat to the life of Mr. Mahto. The doctor told that the only option was the liver transplant without any further delay. In apprehension that it may create chaos among the general public, particularly the supporters of the CM and his party, it was decided to not make the news public. Only very few senior functionaries at the centre and state along with medical staff were aware of the situation. Meanwhile, the Health Minister of the State directed the State's Health Secretary to take necessary actions, coordinate with medical staff and arrange for liver transplant for the CM. The next day, the Health Secretary called the State Director General (DG), Health, who is the competent authority, dealing with the matters related to organ transplantation in the state. The DG, Renuka was informed of the situation and directed to make immediate arrangement for liver transplant. However, Renuka told the Secretary that there is a laid down Standard Operating Procedures (SOPs) regarding organ transplantation. She informed him that there is already a patient named Sunil at first position in the waiting list, who also requires urgent liver transplant. The health secretary is also informed that Sunil is left with a very short time window for a successful transplantation. Sunil is 35 years old, a father of two, and the sole bread winner of the family of six that also includes his wife and aging parents. Sunil's family is of limited means and often found it rather difficult to cater even for their needs. Also, various medical costs associated with Sunil's conditions have further worsened the financial condition of the family. Renuka further informs the secretary, as per SOP, the CM would be at the second position in the waiting list. As a matter of chance, Renuka receives a phone call from one of her subordinates. She informs Renuka that a liver has been donated by family of an old person, who died his natural death. After relevant tests, it was found that the available liver is fit for Sunil. Incidentally, the liver also fits the medical profile of the CM. Renuka immediately intimates the secretary about this development. Even though all the facts with regard to the SOP are explicitly clear, the secretary still tries to persuade Renuka for bending the rule in favor of Mr. Gopal Mahto. He explains that if anything untoward happens to the CM, it may lead to chaos and instability in the State. It may also require fresh elections which will be a drain on state exchequer and a drag on the governance process. He also hinted that if Renuka ‘bent’ the rule, the will be favorable for her career growth in the future. Further, to ease Renuka’s conscience, the health secretary assured her that actions are their actions are in larger interest of the state as well as the country. He also reasoned that if Sunil fails to receive a healthy liver in time, he will personally ensure that Sunil’s family is well taken care of, and an eligible member of his family is accorded with a government job. Meanwhile, the time is running out for both Sunil and the CM. a) What are the ethical concerns associated with the above case study? b) What are the options available with Renuka? Analyse the merits and demerits of the options? c) If you were at the place of Renuka, which option would you choose and why?

Rules versus CompassionEthical Dilemmas in Government
A certain State government was running a welfare scheme for promoting safe motherhood among rural landless laborers’ families. The scheme involves the transfer of funds to the beneficiaries to enable them to mitigate income loss due to maternal care responsibilities. Since its implementation, the scheme has done reasonably well on maternal health and economic indicators. You are the Director of the Department responsible for implementing and operating the scheme. Recently you have been receiving reports of welfare fraud being committed by families by producing fake bona fide. The families committed the fraud with the help of local officials responsible for scrutinizing the bonafide. You were concerned because the fraud being committed was seriously undermining the scheme’s efficiency. You called for a departmental meeting to discuss and find a solution to the problem. In the meeting, it was decided to merge several available government data sets such as Aadhar cards, voter ID cards, marriage certificates, birth certificates, bank details, and other personal assets. By merging all the data sets, the department would be able to develop the beneficiary’s economic profile. And this will help the department scrutinize the documents and detect fraud. This was a comprehensive strategy, but it risked violating an individual’s data privacy. As a Department head, you wanted to detect and prevent fraud, but at the same time, you were apprehensive about violating the Data privacy of the stakeholders. (a) What are the issues involved in the above case? (b) Do you think violating data privacy is justified to prevent welfare fraud? Why / Why not? (c) What, according to you, can be the reasons for such welfare frauds happening in the country? (d) Are there any ways and means to prevent such fraud? Give your suggestions.

You are an IAS officer with 10 years of service. This is your 1st posting as a District Magistrate (DM) in a big city. Prior to this you have always held not so important junior designations in the remote parts of the state. You are happy that you got a lucrative posting and now your children can have good schooling in the city. As a DM, you are appointed as the Returning Officer (RO) for the 18th Lok Sabha elections in your district's parliamentary constituency. In the above capacity, you are responsible for overseeing the electoral process, ensuring conducting a free, fair and transparent election in the constituency as well as upholding the democratic ethos of the constitution and public at large. A powerful politician serving as a minister from the ruling party is contesting election from the constituency. You are well versed with the fact that the minister adopts malpractices during the election. The minister approached and promised you with key positions, career advancements and further promotions in future on the condition that you overlook his corrupt practices during this election. He also warns you of the consequences if his demands are not met. Since, for the past many years, you have been assigned to less significant posts in the state, you cannot simply let go of such postings in near future. 1. You and Ajay were in college together, qualified for the civil services examination, trained, and worked in the same State. Over the years, you and Ajay became good friends and colleagues. Even the families became close to the extent of taking vacations and celebrating festivals together. Professionally, in the last 15 years, both grew, but the paths you and Ajay took differed. You kept your distance from political masters, preferred to be neutral, and refrained from being identified with any group, lobby, or ideology. But Ajay was not discreet about his leanings, and he was well-networked and connected. Because of his networking, Ajay always had postings considered "plum postings." Ajay was posted as CMD of Urban Infrastructure Projects, a high-profile Project with a huge outlay. At the same time, you were working in State Planning Commission for three years and were awaiting your promotion and new posting. When new postings were announced, you were surprised to see your transfer to Vigilance Department. Within a month of taking charge, you were ordered by your Departmental Secretary to conduct an inquiry discreetly into land dealings involving a Minister and his family. You were strictly told to keep it discreet and not to share any information about the investigation with anybody besides the Secretary. As you started the inquiry, you realized Ajay was closely involved with the Minister in shady land deals. As evidence started piling up, you were shocked to notice Ajay's questionable decisions favoring the Minister and friends. Further, you found evidence of Ajay having assets disproportionately much higher than his declared sources of income. When you shared the details with the Secretary, he immediately ordered you to search Ajay's office and home as he believed Ajay was the medium through which they could catch the Minister for shady land deals. You were in a bind as you knew a search operation would tarnish Ajay's reputation and be traumatic for the family. (a) What are the ethical issues and dilemmas involved in the above case? (b) What are the options available to you? (c) Select your chosen course of action after analyzing the options. (d) What must be your moral motivation in the above case? Should it be duty, care, or consequences?
