Mr. Gopal Mahto is the sitting Chief Minister of one of the most populous states in India. He is a young and dynamic leader, popular not just in his state but across the country. Many political analysts opine that he has the potential to become Prime Minister of India in future. One day, the CM was taking a review meeting of law-and-order situation in the state, with senior officials in the state capital. Suddenly he felt a light pain in his abdomen. The CM had been feeling such bouts of pain since a long time, but like always he neglected it this time too, and continued with the meeting. However, in the next few weeks, the intensity of pain increased and the CM was forced to see a doctor. After initial examination, the doctor gave some medicines and prescribed few tests. After few days, the report came and it showed that the CM is suffering from 'Liver Cirrhosis.' It was in the advanced stage and posed a threat to the life of Mr. Mahto. The doctor told that the only option was the liver transplant without any further delay. In apprehension that it may create chaos among the general public, particularly the supporters of the CM and his party, it was decided to not make the news public. Only very few senior functionaries at the centre and state along with medical staff were aware of the situation. Meanwhile, the Health Minister of the State directed the State's Health Secretary to take necessary actions, coordinate with medical staff and arrange for liver transplant for the CM. The next day, the Health Secretary called the State Director General (DG), Health, who is the competent authority, dealing with the matters related to organ transplantation in the state. The DG, Renuka was informed of the situation and directed to make immediate arrangement for liver transplant. However, Renuka told the Secretary that there is a laid down Standard Operating Procedures (SOPs) regarding organ transplantation. She informed him that there is already a patient named Sunil at first position in the waiting list, who also requires urgent liver transplant. The health secretary is also informed that Sunil is left with a very short time window for a successful transplantation. Sunil is 35 years old, a father of two, and the sole bread winner of the family of six that also includes his wife and aging parents. Sunil's family is of limited means and often found it rather difficult to cater even for their needs. Also, various medical costs associated with Sunil's conditions have further worsened the financial condition of the family. Renuka further informs the secretary, as per SOP, the CM would be at the second position in the waiting list. As a matter of chance, Renuka receives a phone call from one of her subordinates. She informs Renuka that a liver has been donated by family of an old person, who died his natural death. After relevant tests, it was found that the available liver is fit for Sunil. Incidentally, the liver also fits the medical profile of the CM. Renuka immediately intimates the secretary about this development. Even though all the facts with regard to the SOP are explicitly clear, the secretary still tries to persuade Renuka for bending the rule in favor of Mr. Gopal Mahto. He explains that if anything untoward happens to the CM, it may lead to chaos and instability in the State. It may also require fresh elections which will be a drain on state exchequer and a drag on the governance process. He also hinted that if Renuka 'bent' the rule, this will be favorable for her career growth in the future. Further, to ease Renuka's conscience, the health secretary assured her that her actions are in larger interest of the state as well as the country. He also reasoned that if Sunil fails to receive a healthy liver in time, he will personally ensure that Sunil's family is well taken care of, and an eligible member of his family is accorded with a government job. Meanwhile, the time is running out for both Sunil and the CM. a) What are the ethical concerns associated with the above case study? b) What are the options available with Renuka? Analyse the merits and demerits of the options? c) If you were at the place of Renuka, which option would you choose and why?

Abha is currently working as the DM of a district. One day, she went to a village for inspecting the progress of a certain village development project. Abha was not satisfied with the pace of the work and wanted to talk with the Sarpanch of the village about the same. Abha went to the panchayat office where she found the Sarpanch standing just outside the office. The Sarpanch greeted Abha and offered her a seat. Abha sat down and started discussing the matter with the Sarpanch. She noticed that Sarpanch was still standing. She thought that Sarpanch was not sitting because of hesitation or out of respect for the officer. She requested him to take a seat but he reluctantly sat on a wooden stool. Abha jokingly asked him if he liked the stool so much that he chose it instead of a chair, to which the Sarpanch replied that he was not allowed to sit on a chair as he belonged to a Dalit community. Abha was taken aback by this response. Abha enquired further about the issue. The sarpanch explained that since the Sarpanch position was reserved for SC community, he won the election. But despite being the official head of the panchayat, he did not have any power. He was neither allowed to enter the panchayat office nor was given access to official documents. A separate water pot was kept for him at the office and he was not allowed to use the common water pot. He worked as a labourer and only signed the given document. He went on to tell Abha that last year he was not allowed to hoist the national flag during the Independence day celebration. Abha was shocked at the severe kind of discrimination that the Sarpanch faced. On the basis of this case study answer the following questions: 1) Why do caste based discriminations still persist even after 75 years of independence? 2) Examine the various ethical issues involved in this case. 3) Identify various stakeholders and their responsibilities for creating an egalitarian society.

The terrorist attack at the Inland Regional Center in San Bernardino, California, on December 2, 2015 resulted into killing of 14 people and injuring 22 others. Both the perpetrators involved in the attack were killed in a shootout by law enforcement later that same day. The Federal Bureau of Investigation (FBI) conducting the investigation recovered an undamaged iPhone in the shootout from one of the shooters. The phone had a six-digit password and was set to eliminate all its data after five failed password attempts. FBI desired access to the data for which it appealed the Apple, a private company, to create a new software that would enable FBI to unlock the phone. They wanted to extract data like contacts, photos and calls from locked iPhones in order to assist in criminal investigations and prosecutions. Apple denied the request of the FBI to build a backdoor into the iPhone. Apple argued that building a backdoor would have far reaching consequence beyond the case and would jeopardize the data security of other Apple users as well. They further explained that while selling their devices, apple has entered into a legal contract promising to preserve the privacy of their users. Allowing government to access the iPhone will lead to breach in trust that exist between the customer and the company. The government suggested utilization of the tool only once for this particular phone. Opposing the suggestion, Apple explained that once created, the technique could be used over and over again, on any number of devices. The company concluded it would be wrong for the government to force them to build a backdoor into their products. The case was widely covered by the print and electronic media. There was a surge in 'for and against' debate on the social media platforms. Tech giants such as Microsoft and Facebook also supported Apple and displayed their opposition to the government's demand for creating a backdoor. The families of victims and survivors of the attack supported the FBI's demand. The National Sheriffs' Association remarked Apple's stance as "putting profit over safety" and "has nothing to do with privacy." Considering the whole situation, do you agree that Apple's action was justified? Why or why not? Make an argument by weighing the competing values in this case.

As the District Commissioner of Wayanad, Kerala, you are responsible for a district renowned for its lush, pristine forests and vibrant tourism sector. This year, however, the region faced unprecedented challenges due to exceptionally heavy rainfall, which far exceeded meteorological predictions. On one night in July, while residents of the Vellarimala hill ranges slept, the stability of the land beneath them began to deteriorate. The situation culminated in a catastrophic landslide, which has been recorded as the most severe landslide disaster in Kerala's history. The twin landslides engulfed the two villages, resulting in the tragic loss of over 360 lives and leaving many missing. The once picturesque hilly landscape was transformed into a scene of utter devastation, with rivers swelling and boulders crashing down. Immediately following the disaster, a contentious blame game ensued between center and state governments regarding adequate warnings. As you arrive at the scene, the sheer scale of destruction is overwhelming, with river waters too strong to allow access to the affected areas and the possibility that survivors might still be trapped within the landslide debris. This disaster highlights a critical issue of our era: the challenge of balancing environmental conservation with economic development. As the district grapples with rising populations, increased consumerism, and the pressures of development, the event underscores the pressing need for responsible stewardship of both natural resources and development practices. In the given circumstance answer the following: a) Identify the ethical issues in the given case. b) Give philosophical perspectives on the environment versus development debate. c) What will be your course of action in the given situation? d) What long-term strategies would you recommend to improve disaster preparedness in the region? You are the General manager of a chemical company, XYZ, located in Panchnagar. Panchnagar is situated on the banks of the river Panch, which is a tributary of one of the major rivers of the country. XYZ was established in Panchnagar with active policy support from the government 20 years ago. XYZ is a major source of employment for the people of Panchnagar. XYZ is involved in various social activities. XYZ has built a primary hospital to attend to the health requirements of the people. It has also built a school in Panchnagar, and gives scholarships to the needy and meritorious children. Though XYZ is making a tremendous contribution to the social and economic growth of Panchnagar, your executive director is not happy with the profits incurred by XYZ in the last quarter. He has exhorted you to cut unnecessary costs and improve the revenue of the company. One day, you receive a letter from an NGO working for environment conservation. The NGO appreciates your company's work for the development of Panchnagar. However, the NGO has cautioned you about certain negative environmental and social impacts associated with the functioning of XYZ. The letter appraises you that a highly toxic chemical is being discharged into the Panch river by the XYZ. According to the studies conducted by the NGO, the toxic chemical may be carcinogenic and may adversely impact the health of people who depend on the river for their water needs. Further, the river is endemic to several endangered species. The release of the chemical waste into the Panch river may be a reason for the declining population of these species. The letter also informs you about a new filtration technology that has been effective in filtering out the toxic waste in question. The NGO's letter exhorts you to take corrective steps to rectify the issue by deploying the new filtration technology. After reading the letter you approach your executive director and brief him about the release of the possibly carcinogenic chemical into the Panch river. You also advise him to install the new filtration technology to ensure that toxic chemical is not discharged into the river. The executive director informs you that he is aware of the new technology which, in his opinion, is not only very expensive but also has a high recurring maintenance cost. The executive director tells you that XYZ is a law-abiding company and all its waste discharges are in compliance with relevant statutory and environmental guidelines. He further reminds you that XYZ is already contributing substantially to the socio-economic development of Panchnagar. Also, the executive director is of the view that the NGO is working in its own vested interests and should not be taken seriously. a) What arguments can you advance to show that doing nothing about the possibly carcinogenic chemical is not morally correct? b) What alternatives do you have in order to ameliorate the situation under the given circumstances?

XYZ is a premiere coaching institute located in Chatterjee Nagar locality of Himnagar. XYZ specialises in the coaching for medical and engineering entrance examination. The main office of the coaching, where the daily classes are conducted, is located in a congested locality, from where several other coaching institutes also operate. One day, while classes were in session in the top floor of the building and some 200 odd students were in attendance, a fire broke out in the premises of XYZ coaching. The fire incident created a commotion among those present in the building. Everyone, in a state of confusion, started running helter-skelter. Some students rushed to the very narrow stairs. Many stumbled and fell, hurting themselves. The emergency exit plan of the building was not suitable to cater to the large number of students and staff. In order to save themselves from asphyxiation, some students broke the window of the classroom. However, in absence of a fire stairs they had to climb down using the balcony ledge. You are a Sub-Divisional Magistrate of a large city, having the reputation of a very honest and upright officer. A huge hospital in your city is working day and night to ensure Emergency services are carried out because of the COVID-19 pandemic. One night, during monsoons, fire engulfed the Covid ward causing instant death of 20 patients including 10 minors. Many more were seriously injured requiring immediate medical attention. The mishap resulted in a big hue and cry, forcing the government to institute an inquiry. Your preliminary enquiry has revealed a series of anomalies. The material used for the cables was of poor quality. Despite the approved building plans permitting only one basement, an additional basement has been constructed which required more power demand causing stress on the system. This was overlooked during the periodic electrical inspections by the building inspector of the municipal corporation. In your enquiry, you noticed that the hospital has more demand of power than sanctioned by the electricity department. Apart from this you also noticed many irregularities in compliance to the fire safety guidelines. There were no proper exit routes indications and many other technical irregularities with respect to fire safety. The permission to have higher load demand and No Objection Certificate for fire safety was accorded by the previous Sub-Divisional Magistrate who is not only your senior and well known to you professionally, but also a good friend. Prima facie, the case appears to be of a widespread nexus between officials of the district administration and the hospitals. Your colleagues are putting pressure on you to go slow in the enquiry. The previous SDM happens to be a close relative of a powerful minister in the state cabinet. The previous SDM is persuading you to hush up the matter, promising you a fortune to do so. He also hinted that if this matter is not resolved at the earliest in his favour there is somebody in his office who is waiting to file a case against you under the POSH Act. You are a Foreign Service official working in an embassy overseas. One of your duties was to liaise with the local Indian community, one of the country's largest immigrant groups. A group of wealthy Indian immigrants wanted to build a place of worship and a school to promote their language and culture. The school was intended to act as a center for promoting and preserving Indian culture among the immigrants. The Indian community leaders went through all the legal procedures to acquire the land, got the building plans approved by the city council, and with all the approvals in place, the construction work began. A few months into the construction, the locals started complaining about noise, and slowly a campaign began against the construction of a religious structure. The local city councilors joined in and raised the issue of how Indian immigrants having their own cultural space will lead to a similar demand from other immigrant communities. And this may escalate intolerance among different ethnic groups. The local politicians filed a public lawsuit to halt the construction and demolish whatever was built. Indian community responded with their lawsuit and approached the embassy for help. They wanted the Ambassador to take up the issue with the government. Meanwhile, the Ambassador deputed you to meet the Indian community leaders to understand the issue and prepare a report. You met with the community leaders and found that the reason for local antipathy towards the Indian community was just an expression of latent racism and intolerance. You presented your observations to the Ambassador and requested him to do something as the Indians were on the right and were being victims of racist behavior. The Ambassador, in turn, replied that he would not like to get involved in local politics. The Indians were citizens of that country; they had nothing to do with India besides ethnicity. Further, a crucial Economic agreement was about to be signed between the two countries in the coming weeks, and he did not want to jeopardize the growing relations between the two countries over some local politics. You were shocked to see economics getting priority over the diaspora. (a) What are the issues involved in the above case? (b) Do you agree with the Ambassador's position of prioritizing economics over helping the diaspora? Why/why not? (c) Among Care, Consequentialism, and Duty, what do you think is the appropriate perspective to guide Indian Foreign policy? Justify.

Recently, an RTI application has been received, demanding details about public infrastructure projects initiated during her tenure. Upon reviewing the requested information, Keerthi discovers that certain decisions made regarding these projects were not entirely sound in hindsight. These decisions, although taken in good faith and after due diligence, failed to realize promised outcomes. There were other employees who were party to this decision. The disclosure of this information could potentially lead to scrutiny and backlash against herself, the employees, and contractors involved. Known for her integrity and commitment to public service, Keerthi finds herself at a crossroads. Mr. X is a renowned Architect. He receives a contract of Rs. 500 crores to design and lead a building project that would not only be an architectural landmark but also involves engineering challenges the solutions for which would change the industry. The building would house the headquarters of a successful company Fictitious Corp. Its chairman, Mr. Y is renowned for his acumen as well as temper. After spending time on the drawing board, Mr. X comes up with an innovative design which in itself is a masterpiece. His office had to lay out the plan and then coordinate with the engineering firms to execute it to perfection. The building is constructed in record time and is praised for its ingenuity and the experts also look at it as an engineering milestone. After six months of its construction, Ms. Z, a doctoral student of mathematics, visits the building for her work on structural engineering calculations. She has immense respect for Mr. X's work. However, she finds that her calculations do not satisfy the requirements of structural integrity for which the building has been widely hailed. She realizes that the building's structure has a deficiency based on the bolted beams used for structural support; this was inadequate if the impact of vertical winds on the building is taken into account. It not only created a threat for the building and its occupants but also the buildings and people nearby. Mr. X is informed of these calculations by the student and her supervisor. However, Mr. X, meticulous as he is, has confidence on his work and detailed design. He looks at the issue seriously and spends time on the design. He indeed finds no flaw in his design and also notes that his design entails the use of welded rather than bolted beams. At the time he is negotiating the construction of another building where the issue of welded versus bolted metal beams is a sticking point. Mr. X. prefers welded beams as they are twice as strong as the requirements are. However, the engineering firm responsible for actual construction job and procuring the steel beams points out that double bolted beams are strong enough to meet the requirement, are cost effective and also fulfill the building code requirements. After the meeting Mr. X visits the Fictitious Corp building, and to his horror he realizes that bolted rather than welded beams have been used in the construction of the building. He asks for the design that his office has used after final approval. He notices that indeed the final designs show the use of bolted beams. These beams are classified as trusses which meet the regulatory requirements but not the structural capacity as envisaged by Mr. X initially. He further enquires and is told that the engineering firm responsible for construction work had also given similar arguments about the sufficiency, cost effectiveness and regulatory [compliance].

Ethical Dilemmas in GovernmentIntegrity
Anand Singh is a government bus conductor working with the Nav Pradesh Transport Corporation. Anand has completed 35 years of service and is due for retirement next year. Anand is happy because he is hopeful of getting his daughter, Madhvi, married from the money he will receive as his retirement benefits. However, Anand's wife pesters him to earn more money in one way or the other. Anand likes his job, and all the passengers in his route vouch for his good nature and helpful behaviour. One day, Suresh, Anand's boss, called Anand in his cabin. He told Anand that a complaint has been filed against him by a person for illegally taking the ticket money from him without issuing the receipt for the ticket. Suresh explained to Anand that this act amounted to misappropriation of government money. Suresh always saw Anand as a decent individual and he asked him as to why he indulged in such an act? Anand, visibly disturbed, told Suresh that as the conductor of a government bus he receives a meagre salary, grossly insufficient to meet the needs of his family. He told him that that his younger daughter, Sarita, suffers from chronic kidney ailment, and requires dialysis twice a week. A huge chunk of his paltry salary goes towards the cost of Sarita's treatment. Moreover, as a single bread-winner of the family, he has to cater to the needs of his elderly parents. Anand further tells Suresh that since last one year a substantial portion of his income goes towards repaying the loan that he took for his elder daughter's college education. Anand laments that even after working for 35 long years, he is unable to provide for his family beyond the bare basic necessities. He tells Suresh that he is aware of many incidents of large-scale corruption in the road transport department that go virtually unnoticed. Further, Anand justifies his act of taking money by highlighting that almost every colleague of his indulges in such practices, and in comparison, to them, what he took, just fifty rupees, is ignorable and paltry. Further, he brought to light the fact that at times they, the conductors, were expected to give their immediate superiors a bribe in the name of convenience fees for various official tasks. While listening to Anand, Suresh feels compassion for him. He decides to verify the veracity of Anand's claim with regard to the dire straits of his financial conditions. On enquiry, all the workers in the office attested to the fact that Anand is going through a very bad phase and that he frequently resorts to short term loans in order to meet his financial requirements. Moreover, the office employees requested Suresh to take a lenient view of Anand's case. They were of the view that if a strong action is taken over such a trivial incident, then it would be highly unjust and unfair towards Anand. On reaching his home, Suresh shared the whole occurrence and Anand's story with his wife. To his surprise, his wife too agreed with the employees of the office. They told him that such small incidents are a routine matter. Also, with rising inflation and increasing obligations, this is the only way for people like Anand to make their ends meet. She asks Suresh to not waste his time and energy over such a small matter. Suresh knows Anand as a hard-working individual who has many mouths to feed at home. Suresh shares genuine sympathy with him, however, he also understands that embezzlement of government money, irrespective of amount and circumstances, is wrong. Now he is in a state of dilemma over his course of action. a) Why are the incidents of petty corruption trivialized? According to you, is it justifiable to ignore small incidents of corruption? b) What are various ethical dilemmas in the above case study?
