You are a District Magistrate and the area lies in your jurisdiction. People from both sides have approached you with their grievances. What would you do to reconcile the two points of view? (b) Mention the merits and demerits of the following potential courses of action: (1) Ignore the opposition from the residents of the area and allow the place of religious worship to be built in accordance with the existing regulations. (2) Prohibit the construction, agreeing with the residents while causing distress among the thousands of worshippers counting on the new place of worship. (3) As a compromise, you place additional building regulations on the worship place or insist on modifications to the design.

The above case highlights the opposition to the construction of a place of worship due to religious differences and its impact on normal lives of locals.

Body · points and prose

a) As a DM, I would first try to pacify both the sides.

I will argue in the following manner:

→ Temple can be built as Mr. Y has right to religion (under Article 25) and the city planners have also not opposed the plan of construction.

→ However, tourism would cause traffic problems and adversely affect environment and lives of locals.

→ I would adopt a middle path to this issue:

→ I will allow construction of place of worship. → However, I will ration the amount of tourists that can visit the temple on a particular day on sustainable basis. → I will start 'online registration system' for tourists. → Thus, online booking will be mandated before anyone comes to visit. This will uphold Right to religion as well as solve traffic problem.

b) POTENTIAL COURSES OF ACTION

  1. Ignore the opposition from the residents of area and allow place of worship.
MERITSDEMERITS
→ Right to practice religion (Article 25) upheld.→ Poor grievance redressal for concerns of locals
→ Faith and trust restored on administration→ Traffic, environmental problems ensue.
→ Impartiality upheld.
  1. PROHIBIT CONSTRUCTION
MERITSDEMERITS
→ Environment conserved→ Article 25 violated
→ Traffic avoid→ I might be called religiously biased.
→ Peace and tranquility of region.→ Withering of impartiality and justice.
  1. COMPROMISE: PLACE ADDITIONAL BUILDING REGULATIONS ON THE WORSHIP PLACE OR INSIST MODIFICATIONS TO DESIGN

MeritsDemerits
→ Upholding of freedom of religion→ This might raise costs for Mr. Y.
→ Middle path→ Appropriate technology may not be available
→ Would harm environment less
→ Duty upheld.

Thus, I will order a fresh Environmental impact assesiment of the region on the hill and determine the carrying capacity of region and accordingly ration the tourists to bring sustainable and inclusive development.
