Question 87: Polity and Governance

Consider the following statements :

  1. IOn the dissolution of the House of the People, the Speaker shall not vacate his/her office until immediately before the first meeting of the House of the People after the dissolution.
  2. IIAccording to the provisions of the Constitution of India, a Member of the House of the People on being elected as Speaker shall resign from his/her political party immediately.
  3. IIIThe Speaker of the House of the People may be removed from his/her office by a resolution of the House of the People passed by a majority of all the then Members of the House, provided that no resolution shall be moved unless at least fourteen days’ notice has been given of the intention to move the resolution.

Which of the statements given above are correct?

aI and II only
bII and III only
cI and III only
dI, II and III

AnswerThe answer is (c).

Under Article 94, the Speaker does not vacate office on the dissolution of the House, but continues until immediately before the first meeting of the new House, so Statement I is correct. The Constitution does not require a Speaker to resign from his or her party; that is a convention, and the Tenth Schedule protects a Speaker who gives up party membership, so Statement II is wrong. The Speaker can be removed by a resolution passed by a majority of all the then members of the House, with at least fourteen days' notice, so Statement III is correct.

  • I. The Speaker continues until just before the first meeting of the new House.
  • II. Leaving the party is a convention; the Constitution does not require it.
  • III. Removal needs a majority of all the then members and fourteen days' notice.

How you could have got this

  1. If you were sure statement II is not correct, (a), (b) and (d) go: each of them includes II.

What you needed to know: Leaving the party is a convention; the Constitution does not require it.

Only (c) is left. You didn’t need statements 1 or 3.

This follows an unofficial answer: UPSC has not published its key for this year, and if that answer is wrong, so is this path.

Which options go is worked out from UPSC’s key and the options, not by a model.

Why each option is right or wrong
  • (a) Wrong: II is a convention, not a constitutional requirement.
  • (b) Wrong: II is incorrect.
  • (c) Right: I and III state Article 94 correctly.
  • (d) Wrong: II is incorrect.
