Question 73: Polity and Governance

If a particular area is brought under the Fifth Schedule of the Constitution of India, which one of the following statements best reflects the consequence of it ?

aThis would prevent the transfer of land of tribal people to non-tribal people.
bThis would create a local self-governing body in that area.
cThis would convert that area into a Union Territory.
dThe State having such areas would be declared a Special Category State.

AnswerUPSC’s answer is (a).

The Fifth Schedule governs the administration and control of Scheduled Areas and Scheduled Tribes in States other than Assam, Meghalaya, Tripura and Mizoram. The Governor can make regulations to prohibit or restrict transfer of tribal land to non-tribals and to regulate money-lending, so option (a) best states the consequence. Autonomous district councils belong to the Sixth Schedule; a Scheduled Area does not become a Union Territory or make a State a Special Category State.

Why each option is right or wrong
  • (a) Correct. The Governor can bar transfer of tribal land to non-tribals.
  • (b) A local self-governing council is a Sixth Schedule feature.
  • (c) Fifth Schedule areas stay part of their State.
  • (d) Special Category status is a separate matter.

Answer: UPSC’s key. Explanation: written by UPSC Grade, not by UPSC.
