UPSC Prelims 2022 · GS Paper I
Question 13: Polity and Governance
Consider the following statements :
- 1.A bill amending the Constitution requires a prior recommendation of the President of India.
- 2.When a Constitution Amendment Bill is presented to the President of India, it is obligatory for the President of India to give his/her assent.
- 3.A Constitution Amendment Bill must be passed by both the Lok Sabha and the Rajya Sabha by a special majority and there is no provision for joint sitting.
Which of the statements given above are correct ?
AnswerUPSC’s answer is (b).
A Constitution Amendment Bill under Article 368 can be introduced in either House and needs no prior recommendation of the President. It must pass each House separately by a majority of the total membership and two-thirds of members present and voting; the joint sitting under Article 108 does not apply to it. After the 24th Amendment (1971), the President must give assent.
- 1. Prior recommendation of the President is needed only for certain other bills, not constitutional amendments.
- 2. Article 368 says the President shall give assent, since the 24th Amendment.
- 3. Each House must pass it by special majority; a deadlock cannot be resolved by joint sitting.
How you could have got this
- If you were sure statement 1 is not correct, (a), (c) and (d) go: each of them includes 1.
What you needed to know: Prior recommendation of the President is needed only for certain other bills, not constitutional amendments.
Only (b) is left. You didn’t need statements 2 or 3.
Which options go is worked out from UPSC’s key and the options, not by a model.
Why each option is right or wrong
- (a) Wrong. Statement 1 is false: no prior presidential recommendation is needed.
- (b) Correct. Assent is obligatory and there is no joint sitting.
- (c) Wrong. Statement 1 is false and statement 2 is missing.
- (d) Wrong. Statement 1 is false.
