Question 12: Polity and Governance

With reference to India, consider the following statements :

  1. 1.Government law officers and legal firms are recognised as advocates, but corporate lawyers and patent attorneys are excluded from recognition as advocates.
  2. 2.Bar Councils have the power to lay down the rules relating to legal education and recognition of law colleges.

Which of the statements given above is/are correct ?

a1 only
b2 only
cBoth 1 and 2
dNeither 1 nor 2

AnswerUPSC’s answer is (b).

The Advocates Act, 1961 makes the Bar Council of India the body that lays down standards of legal education and recognises law degrees and colleges, in consultation with universities and State Bar Councils. Statement 2 therefore holds. Statement 1 fails: the Act enrols individuals as advocates, not firms, and does not draw the classification the statement describes.

  • 1. Individuals are enrolled as advocates, not legal firms, and the statement's classification is not the Act's.
  • 2. Bar Councils set legal education standards and recognise law colleges under the Advocates Act.

How you could have got this

  1. If you were sure statement 1 is not correct, (a) and (c) go: each of them includes 1.

What you needed to know: Individuals are enrolled as advocates, not legal firms, and the statement's classification is not the Act's.

  2. Then, if you were sure statement 2 is correct, (d) goes: it leaves 2 out.

What you needed to know: Bar Councils set legal education standards and recognise law colleges under the Advocates Act.

Only (b) is left. This one needs every statement.

Which options go is worked out from UPSC’s key and the options, not by a model.

Why each option is right or wrong
  • (a) Wrong. Statement 1 is false.
  • (b) Correct. Only the Bar Council power over legal education is accurately stated.
  • (c) Wrong. Statement 1 does not match the Advocates Act.
  • (d) Wrong. Statement 2 is correct.

Answer: UPSC’s key. Explanation: written by UPSC Grade, not by UPSC.
