Question 60: Polity and Governance

Consider the following statements : As per the Industrial Employment (Standing Orders) Central (Amendment) Rules, 2018

  1. 1.if rules for fixed-term employment are implemented, it becomes easier for the firms/companies to lay off workers
  2. 2.no notice of termination of employment shall be necessary in the case of temporary workman

Which of the statements given above is/are correct?

a1 only
b2 only
cBoth 1 and 2
dNeither 1 nor 2

AnswerUPSC’s answer is (c).

Both statements are correct as per UPSC. The 2018 amendment to the Standing Orders rules extended fixed-term employment to all sectors, letting a firm hire for a defined period and end the job when the term ends without notice, which makes it easier to shed workers. The rules also say no notice of termination is needed for a temporary workman. It is best remembered as a labour-market flexibility step.

  • 1. Fixed-term employment makes it easier to part with workers when the term ends.
  • 2. No notice of termination is needed for a temporary workman.

How you could have got this

  1. If you were sure statement 1 is correct, (b) and (d) go: each of them leaves 1 out.

What you needed to know: Fixed-term employment makes it easier to part with workers when the term ends.

  2. Then, if you were sure statement 2 is correct, (a) goes: it leaves 2 out.

What you needed to know: No notice of termination is needed for a temporary workman.

Only (c) is left. This one needs every statement.

Which options go is worked out from UPSC’s key and the options, not by a model.

Why each option is right or wrong
  • (a) Statement 2 is also correct.
  • (b) Statement 1 is also correct.
  • (c) Correct: both statements hold.
  • (d) Both statements are correct, so 'neither' fails.

Worth knowing: The Industrial Employment (Standing Orders) Act, 1946 has since been subsumed in the Industrial Relations Code, 2020.
