Question 92: Polity and Governance
Right to Privacy is protected as an intrinsic part of Right to Life and Personal Liberty. Which of the following in the Constitution of India correctly and appropriately imply the above statement ?
AnswerUPSC’s answer is (c).
In Justice K.S. Puttaswamy v. Union of India (2017), a nine-judge Constitution Bench of the Supreme Court held that the right to privacy is protected as part of the right to life and personal liberty under Article 21, and as part of the freedoms guaranteed in Part III (Fundamental Rights) of the Constitution. Articles 14, 17 and 24 deal with equality, untouchability and child labour respectively.
Why each option is right or wrong
- (a) Article 14 is about equality; the 42nd Amendment is not the source of privacy.
- (b) Article 17 abolishes untouchability.
- (c) Right: Article 21 and the freedoms of Part III.
- (d) Article 24 prohibits child labour in hazardous work.
