Question 96: Polity and Governance

Which of the following are not necessarily the consequences of the proclamation of the President’s rule in a State ?

  1. 1.Dissolution of the State Legislative Assembly
  2. 2.Removal of the Council of Ministers in the State
  3. 3.Dissolution of the local bodies

Select the correct answer using the code given below :

a1 and 2 only
b1 and 3 only
c2 and 3 only
d1, 2 and 3

AnswerUPSC’s answer is (b).

When President's rule is imposed under Article 356, the President takes over the State's executive functions, so the Council of Ministers is necessarily dismissed. The State Legislative Assembly, though, need not be dissolved; it can be kept under suspended animation, and Parliament exercises its powers. Local bodies, such as panchayats and municipalities, continue to function since their existence rests on the Constitution and State laws. So dissolution of the Assembly (1) and of local bodies (3) are not necessary consequences.

  • 1. Not necessarily a consequence: the Assembly can be kept in suspended animation.
  • 2. A necessary consequence: the President takes over executive power.
  • 3. Not necessarily a consequence: local bodies are not dissolved.

How you could have got this

  1. If you were sure statement 2 is not correct, (a), (c) and (d) go: each of them includes 2.

What you needed to know: A necessary consequence: the President takes over executive power.

Only (b) is left. You didn’t need statements 1 or 3.

Which options go is worked out from UPSC’s key and the options, not by a model.

Why each option is right or wrong
  • (a) Wrong: removal of the Council of Ministers (2) is a necessary consequence.
  • (b) Right: dissolution of the Assembly and of local bodies is not necessarily a consequence.
  • (c) Wrong: removal of the Council of Ministers does follow necessarily.
  • (d) Wrong: the Council of Ministers is necessarily removed.

Answer: UPSC’s key. Explanation: written by UPSC Grade, not by UPSC.
