Question 34: Polity and Governance

With reference to the ‘National Intellectual Property Rights Policy’, consider the following statements :

  1. 1.It reiterates India’s commitment to the Doha Development Agenda and the TRIPS Agreement.
  2. 2.Department of Industrial Policy and Promotion is the nodal agency for regulating intellectual property rights in India.

Which of the above statements is/are correct ?

a1 only
b2 only
cBoth 1 and 2
dNeither 1 nor 2

AnswerUPSC’s answer is (c).

India's National Intellectual Property Rights Policy (2016) reaffirms the country's commitment to the Doha Development Agenda and the TRIPS Agreement, while using the flexibilities they allow, so Statement 1 is right. The Department of Industrial Policy and Promotion was the nodal department for IPR matters in the Government, so Statement 2 is right as asked. Remember: the policy keeps India within TRIPS but stresses the public interest.

  • 1. The policy reiterates commitment to the Doha Development Agenda and TRIPS.
  • 2. DIPP was the nodal department for IPR.

How you could have got this

  1. If you were sure statement 1 is correct, (b) and (d) go: each of them leaves 1 out.

What you needed to know: The policy reiterates commitment to the Doha Development Agenda and TRIPS.

  2. Then, if you were sure statement 2 is correct, (a) goes: it leaves 2 out.

What you needed to know: DIPP was the nodal department for IPR.

Only (c) is left. This one needs every statement.

Which options go is worked out from UPSC’s key and the options, not by a model.

Why each option is right or wrong
  • (a) Incomplete: DIPP as nodal agency (2) is also correct.
  • (b) Incomplete: the Doha and TRIPS commitment (1) is also correct.
  • (c) Right: both statements are correct.
  • (d) Wrong: both statements hold.

Worth knowing: DIPP was renamed the Department for Promotion of Industry and Internal Trade (DPIIT) in 2019; the question is answered as it stood in 2017.

Answer: UPSC’s key. Explanation: written by UPSC Grade, not by UPSC.
