The Parliament of India acquires the power to legislate on any item in the State List in the national interest if a resolution to that effect is passed by the

aLok Sabha by a simple majority of its total membership
bLok Sabha by a majority of not less than two-thirds of its total membership
cRajya Sabha by a simple majority of its total membership
dRajya Sabha by a majority of not less than two-thirds of its members present and voting

AnswerUPSC’s answer is (d).

Under Article 249, Parliament can legislate on a State List subject in the national interest if the Rajya Sabha passes a resolution supported by not less than two-thirds of the members present and voting. The Rajya Sabha, as the House of the States, has this special power, not the Lok Sabha. Such a resolution lasts up to one year and can be renewed.

Why each option is right or wrong
  • (a) The Lok Sabha does not pass this resolution.
  • (b) The Lok Sabha does not pass this resolution, whatever the majority.
  • (c) A simple majority of total membership is not the requirement.
  • (d) Right: the Rajya Sabha, by two-thirds of members present and voting.

Answer: UPSC’s key. Explanation: written by UPSC Grade, not by UPSC.
