Question 7: Polity and Governance

Consider the following statements :

  1. 1.Union Territories are not represented in the Rajya Sabha.
  2. 2.It is within the purview of the Chief Election Commissioner to adjudicate the election disputes.
  3. 3.According to the Constitution of India, the Parliament consists of the Lok Sabha and the Rajya Sabha only.

Which of the statements given above is/are correct?

a1 only
b2 and 3
c1 and 3
dNone

AnswerUPSC’s answer is (d).

All three statements are wrong. Delhi and Puducherry have seats in the Rajya Sabha, so Union Territories are represented. Election disputes are decided by the High Courts through election petitions; only disputes about the President's and Vice-President's elections go to the Supreme Court. The Chief Election Commissioner does not adjudicate them. Under Article 79, Parliament consists of the President along with the Lok Sabha and the Rajya Sabha.

  • 1. Delhi and Puducherry have Rajya Sabha seats.
  • 2. Election disputes go to the High Courts; the CEC does not adjudicate them.
  • 3. Parliament also includes the President (Article 79).
Why each option is right or wrong
  • (a) Wrong: Union Territories such as Delhi and Puducherry do send members to the Rajya Sabha.
  • (b) Wrong: the CEC does not decide election disputes, and Parliament includes the President.
  • (c) Wrong: statement 1 is false, and Parliament is not the two Houses alone.
  • (d) Correct: all three statements are false.
