Question 46: Polity and Governance

Consider the following :

  1. 1.Right to education.
  2. 2.Right to equal access to public service.
  3. 3.Right to food.

Which of the above is/are Human Right/Human Rights under "Universal Declaration of Human Rights" ?

a1 only
b1 and 2 only
c3 only
d1, 2 and 3

AnswerThe answer is (d).

The Universal Declaration of Human Rights, 1948 covers all three. Article 26 gives everyone the right to education, Article 21(2) the right of equal access to public service in one's country, and Article 25 the right to a standard of living adequate for health and well-being, including food. In India, education became a fundamental right under Article 21A only in 2002, and the right to food is addressed by the National Food Security Act, 2013.

  • 1. Article 26 of the Declaration guarantees the right to education.
  • 2. Article 21(2) guarantees equal access to public service.
  • 3. Article 25 includes food within an adequate standard of living.

How you could have got this

  1. If you were sure statement 1 is correct, (c) goes: it leaves 1 out.

What you needed to know: Article 26 of the Declaration guarantees the right to education.

  2. Then, if you were sure statement 3 is correct, (a) and (b) go: each of them leaves 3 out.

What you needed to know: Article 25 includes food within an adequate standard of living.

Only (d) is left. You didn’t need statement 2.

This follows an unofficial answer: UPSC has not published its key for this year, and if that answer is wrong, so is this path.

Which options go is worked out from UPSC’s key and the options, not by a model.

Why each option is right or wrong
  • (a) Education is one of the rights, but not the only one.
  • (b) Omits the right to food, covered by Article 25.
  • (c) Omits education and equal access to public service.
  • (d) Right: all three are rights under the Declaration.
