Question 82: Polity and Governance
Consider the following statements :
- 1.The Advocate General of a State in India is appointed by the President of India upon the recommendation of the Governor of the concerned State.
- 2.As provided in Civil Procedure Code, High Courts have original, appellate and advisory jurisdiction at the State level.
Which of the statements given above is/are correct ?
AnswerThe answer is (d).
Both statements are wrong. The Advocate General of a State is appointed by the Governor, not the President, under Article 165. A High Court's jurisdiction comes from the Constitution and other laws, not from the Civil Procedure Code, and advisory jurisdiction rests with the Supreme Court (Article 143), not the High Courts.
- 1. The Governor appoints the Advocate General (Article 165).
- 2. High Courts have no advisory jurisdiction, and it does not come from the Civil Procedure Code.
How you could have got this
- If you were sure statement 1 is not correct, (a) and (c) go: each of them includes 1.
What you needed to know: The Governor appoints the Advocate General (Article 165).
- Then, if you were sure statement 2 is not correct, (b) goes: it includes 2.
What you needed to know: High Courts have no advisory jurisdiction, and it does not come from the Civil Procedure Code.
Only (d) is left. This one needs every statement.
This follows an unofficial answer: UPSC has not published its key for this year, and if that answer is wrong, so is this path.
Which options go is worked out from UPSC’s key and the options, not by a model.
Why each option is right or wrong
- (a) Wrong: the Governor appoints the Advocate General.
- (b) Wrong: High Courts have no advisory jurisdiction.
- (c) Wrong: both statements are false.
- (d) Right: both statements are wrong.
