The Parliament can make any law for the whole or any part of India for implementing international treaties
awith the consent of all the States
bwith the consent of the majority of States
cwith the consent of the States concerned
dwithout the consent of any State
AnswerThe answer is (d).
Under Article 253 Parliament can make any law for the whole or any part of India to implement a treaty, agreement or convention with another country, or a decision of an international body. This power covers even subjects on the State List, and it does not need the consent of any State. It is an exception to the usual division of powers.
Why each option is right or wrong
- (a) Consent of all States is not needed under Article 253.
- (b) Consent of a majority of States is not needed.
- (c) Consent of the States concerned is not needed.
- (d) Right: Parliament can legislate on treaties without the consent of any State.
