Stem Cell Therapy Regulation in India

GS2 HealthGS3 Science and technologyPrelims and Mains

In the news since 17 September 2026

Why in news
On 17 September 2026 the Health Ministry announced an advisory dated 16 September 2026 to States and UTs on regulating stem cell therapy, following the Supreme Court's 30 January 2026 judgment in Yash Charitable Trust v. Union of India.
What it is
Stem cell research and therapy in India is governed by the National Guidelines for Stem Cell Research, 2017 (ICMR and DBT), along with drugs and clinical establishment rules. Stem cell therapy is treated as an experimental intervention unless the Ministry approves the indication. The Clinical Establishments Act, 2010 regulates registration and standards of clinical establishments in States that have adopted it.
Advisory scope
Issued on 16 September 2026 to States and UTs that have adopted the Clinical Establishments Act, 2010.
Standard care rule
Stem cell therapy is allowed as routine standard care only for indications on the Ministry-approved list.
Autism
Any therapeutic use of stem cells in autism stays restricted to approved clinical trials under the 2017 National Guidelines issued by ICMR and DBT.
Penalties
Non-compliance can mean professional misconduct under Regulation 7.22 of the IMC Regulations, 2002, and action under Sections 32 and 40 of the Clinical Establishments Act (cancellation of registration and penalty).

Don’t confuse with ICMR vs DBT: ICMR is the apex body for biomedical research under the Health Ministry; DBT is under the Ministry of Science and Technology. The 2017 stem cell guidelines were issued jointly by both.

Don’t confuse with NMC vs State Medical Councils: The NMC sets national standards and issued an advisory. State Medical Councils examine individual cases of alleged misconduct and take disciplinary action.

Laws, judgments and statutory bodies: 30 Prelims questions since 2013 (what the law says, who chairs, legal basis). In Mains, 44 news-triggered questions, most in GS2, asking for provisions and challenges.
