Question 84: Polity and Governance

Consider the following statements :

  1. 1.It is the Governor of the State who recognizes and declares any community of that State as a Scheduled Tribe.
  2. 2.A community declared as a Scheduled Tribe in a State need not be so in another State.

Which of the statements given above is/are correct ?

a1 only
b2 only
cBoth 1 and 2
dNeither 1 nor 2

AnswerUPSC’s answer is (b).

Statement 1 is wrong: under Article 342 it is the President, by public notification after consulting the Governor of the State concerned, who specifies the Scheduled Tribes for that State, and Parliament alone can later change the list by law. The Governor does not declare them. Statement 2 is right: the list is State-specific, so a community may be a Scheduled Tribe in one State and not in another.

  • 1. The President notifies Scheduled Tribes under Article 342, after consulting the Governor.
  • 2. The Scheduled Tribe list is specific to each State.

How you could have got this

  1. If you were sure statement 1 is not correct, (a) and (c) go: each of them includes 1.

What you needed to know: The President notifies Scheduled Tribes under Article 342, after consulting the Governor.

  2. Then, if you were sure statement 2 is correct, (d) goes: it leaves 2 out.

What you needed to know: The Scheduled Tribe list is specific to each State.

Only (b) is left. This one needs every statement.

Which options go is worked out from UPSC’s key and the options, not by a model.

Why each option is right or wrong
  • (a) Wrong: the President, not the Governor, notifies Scheduled Tribes.
  • (b) Right: the list is State-wise, and the Governor does not declare Scheduled Tribes.
  • (c) Wrong: statement 1 is incorrect.
  • (d) Wrong: statement 2 is correct.

Answer: UPSC’s key. Explanation: written by UPSC Grade, not by UPSC.
