Question 20: Polity and Governance
With reference to Deputy Speaker of Lok Sabha, consider the following statements :
- 1.As per the Rules of Procedure and Conduct of Business in Lok Sabha, the election of Deputy Speaker shall be held on such date as the Speaker may fix.
- 2.There is a mandatory provision that the election of a candidate as Deputy Speaker of Lok Sabha shall be from either the principal opposition party or the ruling party.
- 3.The Deputy Speaker has the same power as of the Speaker when presiding over the sitting of the House and no appeal lies against his rulings.
- 4.The well established parliamentary practice regarding the appointment of Deputy Speaker is that the motion is moved by the Speaker and duly seconded by the Prime Minister.
Which of the statements given above are correct ?
AnswerUPSC’s answer is (a).
Rule 8 of Lok Sabha's Rules of Procedure lets the Speaker fix the date for the Deputy Speaker's election, so statement 1 is true. When presiding, the Deputy Speaker has the Speaker's powers and his rulings cannot be appealed. No rule requires the post to go to the ruling or principal opposition party; giving it to the opposition is a convention. The Speaker does not move the motion for the election; a member proposes the name and another seconds.
- 1. The Speaker fixes the date of the Deputy Speaker's election.
- 2. There is no mandatory party requirement; allotment to the opposition is only a convention.
- 3. While presiding, the Deputy Speaker has the Speaker's powers and his rulings are final.
- 4. The Speaker does not move the motion; a member proposes and another seconds.
How you could have got this
- If you were sure statement 1 is correct, (c) and (d) go: each of them leaves 1 out.
What you needed to know: The Speaker fixes the date of the Deputy Speaker's election.
- Then, if you were sure statement 2 is not correct, (b) goes: it includes 2.
What you needed to know: There is no mandatory party requirement; allotment to the opposition is only a convention.
Only (a) is left. You didn’t need statements 3 or 4.
Which options go is worked out from UPSC’s key and the options, not by a model.
Why each option is right or wrong
- (a) Correct. Statements 1 and 3 hold.
- (b) Wrong. Statement 2 is false: no mandatory party rule exists.
- (c) Wrong. Statement 4 is false.
- (d) Wrong. Statements 2 and 4 are both false.
