Question 82: Polity and Governance

With reference to India, consider the following statements :

  1. 1.Judicial custody means an accused is in the custody of the concerned magistrate and such accused is locked up in police station, not in jail.
  2. 2.During judicial custody, the police officer in charge of the case is not allowed to interrogate the suspect without the approval of the court.

Which of the statements given above is/are correct?

a1 only
b2 only
cBoth 1 and 2
dNeither 1 nor 2

AnswerUPSC’s answer is (b).

Judicial custody means the accused is in the custody of the magistrate and is held in jail, not in a police station; police custody is the one in which the accused is kept in the police lock-up. While the accused is in judicial custody, the investigating police officer cannot interrogate the accused without the court's permission. Remember: police custody is at the police station; judicial custody is in jail under the court.

  • 1. In judicial custody the accused is in jail, not in a police station.
  • 2. The police need the court's approval to interrogate an accused in judicial custody.

How you could have got this

  1. If you were sure statement 1 is not correct, (a) and (c) go: each of them includes 1.

What you needed to know: In judicial custody the accused is in jail, not in a police station.

  2. Then, if you were sure statement 2 is correct, (d) goes: it leaves 2 out.

What you needed to know: The police need the court's approval to interrogate an accused in judicial custody.

Only (b) is left. This one needs every statement.

Which options go is worked out from UPSC’s key and the options, not by a model.

Why each option is right or wrong
  • (a) Wrong: statement 1 is false, since judicial custody means jail, not a police station.
  • (b) Right: only statement 2 is correct.
  • (c) Wrong: statement 1 is false.
  • (d) Wrong: statement 2 is correct.

Answer: UPSC’s key. Explanation: written by UPSC Grade, not by UPSC.
