Question 79: Polity and Governance
‘Right to Privacy’ is protected under which Article of the Constitution of India?
AnswerUPSC’s answer is (c).
In Justice K.S. Puttaswamy v. Union of India (2017), a nine-judge bench of the Supreme Court held that the right to privacy is a fundamental right, protected as part of the right to life and personal liberty under Article 21 and as an intrinsic part of the freedoms in Part III. Article 19 protects the freedoms of speech and movement, Article 15 prohibits discrimination, and Article 29 protects the interests of minorities.
Why each option is right or wrong
- (a) Wrong: Article 15 prohibits discrimination.
- (b) Wrong: Article 19 gives the six freedoms; privacy is not located there primarily.
- (c) Right: privacy is protected under Article 21.
- (d) Wrong: Article 29 protects minority culture and language.
