Question 18: Polity and Governance

With reference to the provisions contained in Part IV of the Constitution of India, which of the following statements is/are correct ?

  1. 1.They shall be enforceable by courts.
  2. 2.They shall not be enforceable by any court.
  3. 3.The principles laid down in this part are to influence the making of laws by the State.

Select the correct answer using the code given below :

a1 only
b2 only
c1 and 3 only
d2 and 3 only

AnswerUPSC’s answer is (d).

Article 37 says the Directive Principles in Part IV shall not be enforceable by any court, yet are fundamental in the governance of the country, and it is the State's duty to apply them in making laws. So statement 2 (non-justiciable) and statement 3 (they guide lawmaking) are correct, and statement 1 contradicts Article 37.

  • 1. Article 37 makes them non-enforceable by courts.
  • 2. They are not enforceable by any court.
  • 3. The State must apply the principles in making laws.

How you could have got this

  1. If you were sure statement 1 is not correct, (a) and (c) go: each of them includes 1.

What you needed to know: Article 37 makes them non-enforceable by courts.

  2. Then, if you were sure statement 3 is correct, (b) goes: it leaves 3 out.

What you needed to know: The State must apply the principles in making laws.

Only (d) is left. You didn’t need statement 2.

Which options go is worked out from UPSC’s key and the options, not by a model.

Why each option is right or wrong
  • (a) Wrong: Part IV cannot be enforced by courts.
  • (b) Wrong: omits statement 3, which is correct.
  • (c) Wrong: includes statement 1, which is false.
  • (d) Right: not enforceable by courts, but they guide the State in making laws.

Answer: UPSC’s key. Explanation: written by UPSC Grade, not by UPSC.
