Question 53: Polity and Governance

With reference to the Legislative Assembly of a State in India, consider the following statements :

  1. 1.The Governor makes a customary address to Members of the House at the commencement of the first session of the year.
  2. 2.When a State Legislature does not have a rule on a particular matter, it follows the Lok Sabha rule on that matter.

Which of the statements given above is/are correct?

a1 only
b2 only
cBoth 1 and 2
dNeither 1 nor 2

AnswerUPSC’s answer is (c).

Both statements are correct. Under Article 176 the Governor addresses the Legislative Assembly, or both Houses together, at the first session after each general election and at the first session of each year, and informs the legislature of the reasons for its summons. Where the state's own rules of procedure are silent on a matter, the Speaker can be guided by the rules and practice of the Lok Sabha.

  • 1. The Governor addresses the first session of the year under Article 176.
  • 2. Where a state has no rule, Lok Sabha rules guide the House.

How you could have got this

  1. If you were sure statement 1 is correct, (b) and (d) go: each of them leaves 1 out.

What you needed to know: The Governor addresses the first session of the year under Article 176.

  2. Then, if you were sure statement 2 is correct, (a) goes: it leaves 2 out.

What you needed to know: Where a state has no rule, Lok Sabha rules guide the House.

Only (c) is left. This one needs every statement.

Which options go is worked out from UPSC’s key and the options, not by a model.

Why each option is right or wrong
  • (a) Statement 2 is also correct.
  • (b) Statement 1 is also correct.
  • (c) Correct: both the Governor's address and the Lok Sabha rule fallback hold.
  • (d) Both statements are correct, so 'neither' fails.

Answer: UPSC’s key. Explanation: written by UPSC Grade, not by UPSC.
