Consider the following statements :
- 1.No criminal proceedings shall be instituted against the Governor of a State in any court during his term of office.
- 2.The emoluments and allowances of the Governor of a State shall not be diminished during his term of office.
Which of the statements given above is/are correct ?
AnswerUPSC’s answer is (c).
Article 361(2) bars any criminal proceedings against a Governor in any court during the term of office; civil proceedings need two months' prior notice (Article 361(4)). Article 158(4) says the Governor's emoluments and allowances shall not be diminished during the term of office. Both statements are therefore correct. Remember: the immunity under Article 361 covers the President as well as Governors.
- 1. Article 361(2) bars criminal proceedings against a Governor during the term.
- 2. Article 158(4): emoluments and allowances are not diminished during the term.

- If you were sure statement 1 is correct, (b) and (d) go: each of them leaves 1 out.

- Then, if you were sure statement 2 is correct, (a) goes: it leaves 2 out.
