Question 39: Polity and Governance

Consider the following statements :

  1. 1.The Speaker of the Legislative Assembly shall vacate his/her office if he/she ceases to be a member of the Assembly.
  2. 2.Whenever the Legislative Assembly is dissolved, the Speaker shall vacate his/her office immediately.

Which of the statements given above is/are correct ?

a1 only
b2 only
cBoth 1 and 2
dNeither 1 nor 2

AnswerUPSC’s answer is (a).

Article 179 says the Speaker of a Legislative Assembly vacates office if he or she ceases to be a member of the Assembly, resigns in writing to the Deputy Speaker, or is removed by a resolution of the Assembly passed by a majority of all its then members, with 14 days' notice. On dissolution the Speaker does not vacate at once: the Speaker continues in office until just before the first meeting of the new Assembly. The same rule applies to the Lok Sabha Speaker under Article 94.

  • 1. Ceasing to be a member ends the Speaker's office (Article 179).
  • 2. The Speaker stays until just before the new Assembly's first meeting.

How you could have got this

  1. If you were sure statement 1 is correct, (b) and (d) go: each of them leaves 1 out.

What you needed to know: Ceasing to be a member ends the Speaker's office (Article 179).

  2. Then, if you were sure statement 2 is not correct, (c) goes: it includes 2.

What you needed to know: The Speaker stays until just before the new Assembly's first meeting.

Only (a) is left. This one needs every statement.

Which options go is worked out from UPSC’s key and the options, not by a model.

Why each option is right or wrong
  • (a) Right: statement 1 is correct, and the Speaker stays on after dissolution.
  • (b) Wrong: the Speaker continues after dissolution.
  • (c) Wrong: statement 2 is false.
  • (d) Wrong: statement 1 is true (Article 179).
