Question 21: Polity and Governance
The Parliament can make any law for whole or any part of India for implementing international treaties
awith the consent of all the States
bwith the consent of the majority of States
cwith the consent of the States concerned
dwithout the consent of any State
AnswerUPSC’s answer is (d).
Article 253 empowers Parliament to make any law for the whole or any part of India to implement a treaty, agreement or convention with another country, or a decision of an international conference. This overrides the usual division of powers between the Union and the States, so even subjects in the State List can be covered, and no State's consent is needed.
Why each option is right or wrong
- (a) Wrong. Consent of all States is not required.
- (b) Wrong. Consent of a majority of States is not required.
- (c) Wrong. Even the States concerned need not consent.
- (d) Correct. Article 253 lets Parliament legislate without any State's consent.
