Question 87: Polity and Governance
Consider the following statements :
- 1.Central Administrative Tribunal (CAT) was set up during the Prime Ministership of Lal Bahadur Shastri.
- 2.The Members for CAT are drawn from both judicial and administrative streams.
Which of the statements given above is/are correct ?
AnswerThe answer is (b).
Statement 2 is correct: the Central Administrative Tribunal has both judicial and administrative members, so that service cases are heard by people with both legal and administrative experience. Statement 1 is wrong: the CAT was set up in 1985 under the Administrative Tribunals Act, in Rajiv Gandhi's time as Prime Minister, not Lal Bahadur Shastri's (1964-66). It rests on Article 323A.
- 1. CAT was set up in 1985, under Rajiv Gandhi, not Shastri.
- 2. CAT members come from judicial and administrative streams.
How you could have got this
- If you were sure statement 1 is not correct, (a) and (c) go: each of them includes 1.
What you needed to know: CAT was set up in 1985, under Rajiv Gandhi, not Shastri.
- Then, if you were sure statement 2 is correct, (d) goes: it leaves 2 out.
What you needed to know: CAT members come from judicial and administrative streams.
Only (b) is left. This one needs every statement.
This follows an unofficial answer: UPSC has not published its key for this year, and if that answer is wrong, so is this path.
Which options go is worked out from UPSC’s key and the options, not by a model.
Why each option is right or wrong
- (a) Wrong: CAT was not set up under Shastri.
- (b) Right: only statement 2 is correct.
- (c) Wrong: statement 1 is false.
- (d) Wrong: statement 2 is true.
