Question 7: Polity and Governance
Consider the following statements:
- 1.The highest criminal court of the district is the Court of District and Sessions Judge.
- 2.District Judge are appointed by the Governor in consultation with the High Courts.
- 3.A person to be eligible for appointment as a District Judge should be an advocate or a pleader of seven years' standing or more, or a member of a judicial service of the State.
- 4.When the Sessions Judge awards death sentence, it must be confirmed by the High Court before it is carried out.
Which of these statements given above are correct?
AnswerThe answer is (d).
All four statements are correct. The Court of the District and Sessions Judge is the highest criminal court in a district. Under Article 233 the Governor appoints district judges in consultation with the High Court. A person not already in government judicial service must have been an advocate or pleader for at least seven years. A death sentence passed by a Sessions Judge is carried out only after the High Court confirms it.
- 1. The Sessions Court is the district's highest criminal court.
- 2. Article 233: the Governor appoints in consultation with the High Court.
- 3. Seven years as an advocate or pleader, or service of the State, makes one eligible.
- 4. A death sentence needs High Court confirmation before execution.
How you could have got this
- If you were sure statement 1 is correct, (b) goes: it leaves 1 out.
What you needed to know: The Sessions Court is the district's highest criminal court.
- Then, if you were sure statement 4 is correct, (a) and (c) go: each of them leaves 4 out.
What you needed to know: A death sentence needs High Court confirmation before execution.
Only (d) is left. You didn’t need statements 2 or 3.
This follows an unofficial answer: UPSC has not published its key for this year, and if that answer is wrong, so is this path.
Which options go is worked out from UPSC’s key and the options, not by a model.
Why each option is right or wrong
- (a) Leaves out statements 3 and 4, which are also correct.
- (b) Leaves out statement 1, which is also correct.
- (c) Leaves out statements 2 and 4, which are also correct.
- (d) Correct: all four statements hold.
