Question 148: Polity and Governance
The Ninth Schedule to the Indian Constitution was added by
aFirst Amendment
bEighth Amendment
cNinth Amendment
dForty second Amendment
AnswerThe answer is (a).
The Ninth Schedule was added by the First Amendment Act of 1951, to protect land reform and other laws from challenge in the courts. Laws placed there were meant to be immune from judicial review, but in the I R Coelho case (2007) the Supreme Court held that laws added after 24 April 1973 are open to review on the basis of the Constitution's basic structure.
Why each option is right or wrong
- (a) Correct: the First Amendment, 1951.
- (b) The Eighth Amendment extended reservation of seats in legislatures.
- (c) The Ninth Amendment dealt with the transfer of territories after the agreement with Pakistan.
- (d) The 42nd Amendment (1976) made many changes but did not add the Ninth Schedule.
