Question 69: Polity and Governance
The Supreme Court of India tenders’ advice to the President on a matter of law or fact
AnswerThe answer is (b).
The Supreme Court gives advice to the President only when he seeks it, under Article 143. The President can refer a question of law or fact of public importance, and the Court may give its opinion. The opinion is advisory and is not binding on the President. The Court cannot take up such a matter on its own, and the reference need not concern Fundamental Rights or national unity.
Why each option is right or wrong
- (a) The Court cannot advise on its own initiative.
- (b) Right: only when the President seeks advice under Article 143.
- (c) The reference can be on any question of public importance, not only Fundamental Rights.
- (d) The reference is not limited to threats to unity and integrity.
