Question 71: Polity and Governance

Which one of the following are/is stated in the Constitution of India? I. The President shall not be a member of either House of Parliament. II. The Parliament shall consist of the President and two Houses. Choose the correct answer from the codes given below:

aNeither I nor II
bBoth I and II
cI alone
dII alone

AnswerThe answer is (b).

Both statements are in the Constitution. Article 59(1) says the President shall not be a member of either House of Parliament; if a member of a House is elected President, his seat in that House is deemed vacated when he enters office. Article 79 says Parliament consists of the President and two Houses, the Lok Sabha and the Rajya Sabha. So the President is part of Parliament without being a member of either House.

  • I. Article 59(1): the President cannot be a member of either House.
  • II. Article 79: Parliament consists of the President and the two Houses.
Why each option is right or wrong
  • (a) Both statements are in the Constitution, so neither-nor is wrong.
  • (b) Right: Article 59(1) and Article 79 state them.
  • (c) Statement II is also in the Constitution, in Article 79.
  • (d) Statement I is also in the Constitution, in Article 59(1).
