- Why in news
- On 10 September 2026 the Department of Consumer Affairs amended the Consumer Protection (E-Commerce) Rules, 2020 through the Consumer Protection (E-Commerce) (Amendment) Rules, 2026. The new Rules come into force on 1 January 2027.
- What it is
- The Consumer Protection (E-Commerce) Rules, 2020 are made under the Consumer Protection Act, 2019. They set duties for e-commerce entities, including grievance redressal, seller and product disclosures, and a bar on unfair trade practices. They are the main regulatory framework for online marketplaces and inventory-based sellers.
- Commencement
- The Amendment Rules, 2026 apply from 1 January 2027.
- National Consumer Helpline
- Every e-commerce entity must join the convergence process of the National Consumer Helpline.
- Prior price
- When a price cut is announced, both the reduced and prior price must be shown. Prior price is the lowest price in the 30 days before the announcement.
- Dark patterns
- Entities must follow the Dark Patterns Guidelines, 2023, do a yearly self-audit and display a compliance certificate.
- NCH grievances in 2025
- NCH received 17,71,622 grievances in 2025, about 29 per cent of them on e-commerce.
Don’t confuse with Consumer Protection Act 1986 vs 2019: The 2019 Act replaced the 1986 Act. The E-Commerce Rules, 2020 stem only from the 2019 Act, which also created the CCPA.
Don’t confuse with Dark Patterns Guidelines, 2023 vs E-Commerce Rules: The Guidelines are a separate CCPA instrument. The 2026 amendment makes e-commerce entities comply with them.
Laws, judgments and statutory bodies: 30 Prelims questions since 2013 (what the law says, who chairs, legal basis). In Mains, 44 news-triggered questions, most in GS2, asking for provisions and challenges.
Why it matters
- Curbs manipulative design, misleading search results and hidden fees, strengthening consumer rights online.
- Links platforms to the National Consumer Helpline, giving consumers one grievance route for a sector with about 29 per cent of 2025 complaints.
- Mandatory disclosure of prior price, origin and importer details improves transparency.
Problems
- Compliance cost and ambiguity in judging what counts as manipulated search results may burden smaller platforms.
- Enforcement of rules, as opposed to guidelines, needs a capable regulator and monitoring of algorithms.
- Rules made under an Act cannot widen it, so legal challenges on scope are possible.
Way forward
- Issue clear compliance guidance and phase in obligations for small sellers.
- Strengthen CCPA's technical capacity to audit algorithms and act on dark patterns.
- Publish platform-wise grievance data to track outcomes.
